Lincoln County considers off-road ordinance Rule that would allow bans by rural residents set for Dec. 2 public hearing

The Lincoln County Commission is ready to take public comment on a plan that could ban most four-wheelers in ditches next to certain county roads.

The commission voted unanimously to set a first reading and public hearing of an off-road ordinance for 7 p.m. Dec. 2 at the Lincoln County Courthouse in Canton.

The ordinance does not prohibit the use of off-road vehicles but allows residents to petition to have them banned for all but agricultural purposes on sections of county-controlled roads and ditches.

A public hearing would need to be held before commissioners could approve a ban on any section of road.

Deputy State's Attorney Mike Nadolski presented a draft of the ordinance at a recent commission meeting in response to concerns presented by Harrisburg resident Willis Hanna.

On Oct. 28, Hanna attended the meeting with three other rural residents with similar concerns.

Rural Harrisburg's Don Hoffman said off-road drivers have softened the shoulder of his driveway by jumping it at high speed, which he said makes it dangerous for him to haul cattle across it.

"I think something needs to stop when somebody's recreation is costing somebody else money," Hoffman said.

He also said snowmobiles and four-wheelers have flown by when his daughter and granddaughters were preparing to pull out of his driveway, he said.

"If you guys can't stop them, I will," Hoffman said.

Highway Superintendent Allan Bonnema said four-wheelers cause damage to county roads, as well but said he wasn't sure how effective a ban could be.

"It's going to be hard to catch these guys - they go where the deputies can't go," Bonnema said.

State law ties the county's hands somewhat, Nadolski said.

State law allows only local governments to regulate off-road vehicles on roads that government controls. Resident petitions presented to the commission could not ban the use of four-wheelers on state or township roads.

He also said that snowmobiles and four-wheelers are defined differently under state law and that the ordinance would not apply to snowmobiles. He added that the county does not have the authority to regulate them.

State law also allows persons as young as 12 to use public right-of-ways for agricultural purposes without a license.

Commissioners Dennis Weeldryer and Dale Long both said that loophole could make enforcement difficult even when violators are apprehended, as they might say they simply are driving from one field to another.

Nadolski said he hopes the "No off-road vehicles" signs that would need to be placed on successfully petitioned stretches of road would serve as a deterrent.

Commissioner Jim Schmidt said the ordinance deserves a public hearing but agreed that enforcement will be difficult and could further stretch the Lincoln County Sheriff's Department.

"Every time we do one of these, we increase the amount of expectation on our law enforcement at a time when our budgets are being squeezed," Schmidt said.

Above is a link to the Lincoln County Commisioners -  names phone numbers and addresses. I  think it would be a good idea if any of you have a chance to talk to or know any of them tell them your concerns.  I know Otto Hagedorn pretty well and I also know he rides a UTV on county roads in the Tea area and I plan on talking to him before the meeting so I can and see what he thinks.
  My son and I do a little ditch riding and fair amount of riding on the gravel and I would sure hate to lose that right. We try to be respectful of peoples driveways and stay away from the ditches that people obviously maintain as an extesion of their yard (even though it is a public right of way).

they cant do to much if you have a license plate on the four wheeler. and say if you were spinning around and tearing up the roads they could give you a exhibition driving ticket. obviously there is some people out there screwing it up for the rest of us. that pisses me off i try to be as legal as possible and we are the ones that get screwed in the long run. i think the ones that are screwing around need there ass kick. come on understand if you screw that up the more stuff is going to get closed for us to use.  >:( >:( >:(

You would think that someone with some "pull" up top would look at this situation as an opportunity to put in more riding areas for us to use.  There just aren't enough riding areas and way too many riders in this area for the amount of areas we have.  I guess these people would rather see unliscensed ATVs screwing around on the highways instead, right?  It takes just as many cops to enforce laws keeping unliscensed ATVs off the streets as it would take to enforce new ordinances and laws.  They are putting in all those fancy paved bike paths all over parks and wherever and that can't be cheap.  Why can't they spend a little of they're moldy money on ATV riding areas instead of fancy new sports stadiums and crap all the time.  Whew, time to take a breath Darren!  This subject just irks me to no end.  Next thing they'll take away is our guns.  But that's another story.

When I lived in Watertown, they tried pulling this same deal......they at one point were gonna ban atv use within city limits.....but it all went away, especially when a couple city officials own atv/utv's.......its gradeschool all over again, the actions of the few hurt the many......last I knew in watertown certain areas had signs posted in ditches....and that was the extent of it....who knows

I haven't seen any signs around Watertown, but I know the quads have really lessened in the ditches.  Not sure if it's cause most of them are street legal now or what.  The ditch along 212 on the west side of town really got tore up though.  All the gravel approches had really bad ruts across them from quads spinning all the way across

   Liscensed or not , if they ban them , you cant ride them on any county controlled road.  What you have to remember is most gravel roads are controlled by townships.  I would guess less that 20% are county controlled .

   All it will do is change where you ride.   Its no different than the state ban on atvs on the interstate system.

THey cant stop a licensed at from riding on state or township roads because of the state law. The Reason we cant ride the interstate is its federal and ATV;s are not DOT approved for the road.

If your machine is licensed the county can't ban you from riding on the roads.  They can however ban you from riding in the ditches.

I have riden mine on I-90 from Brandon to the Valley Springs exit.  It is only 10-12 miles.  I have seen guys get on 29 from Crooks and ride into SF.
